No he doesn't have pending GC status.His wife is on 4th year of H1 and she already got EAD.But her priority date is not current (Sept 06)to add him to her GC status immediately.

Hello All,
My employer is planning to apply for my Green card (labor) next month. My employer has multiple work locations. My employer is going to apply the green card from Washington DC office location but I stay in Delaware and work from Delaware Office Location.
1. Will this impact the process in any way?
2. Do I have to move to Washington DC office to work at any point during the Green Card process? If yes, please let me know at what stage?
3. And if I have to move to Washington DC office to work then do I have to move to stay in Washington DC or can i still stay in Delaware and work from Washington DC?

You have to return both I-94's while ticketing ie before exiting and while entering at POE IO will give you new I-94 based on AP as Paroled AOS pending..
Ofcourse keep your copy of I-94 from your H1 Extension I-797 approval notice.

I have EAD, AP and H-1B. I don't have H-1b stamped on my passport. I would like to travel on AP.
According to my lawyer;
"For every paper (AP) you have, you can make one trip with it. So if you have 3 original papers, you make 3 trips in and out of the country."
Is this true? My friends who traveled outside the country were told at the port of entry that AP can be used for multiple entry and the above does not hold true.
Any insight would be appreciated.

Hi
I got laid-off in Jan'09 and was not able to get a job. I returned back to India on 01-May-2009. I would like to come back to US since the economy is coming-up. Below is my situation:
Filed I-485 and it is in Pending status (Priority Date is May-2007). I-140 approved in Jan 2008.
Renewed EAD which is valid till July 2010. But AP got expired by 15-July-2009.
6 years of H1B expired by 31-May-2009.
1. What are my options now to come back to US?
2. When can I file for my new H1B? I heard there should be 1 year gap between H1B.
3. Will I be considered in regular quota OR I will get H1B on previously held quota?
Your suggestion will greatly help. Appreciate it.

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.

This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

I am really unclear about the whole process of the i-90. My situation as whole is unclear to
me. I gave a call to the USCIS to find out my status since i recieved my welcome letter by mail only to find out that my green card has been mailed back by usps and labeled "undeliverable". I dont know exactly what happen but i already started an i-90. If i wanted to travel outside the US, what would i need? I have seen people suggesting getting an i-551 stamp. But those people were renewing their green card. Would my situation be different as I actually never held a green card. Would they still stamp

I have been working as a consultant, due to the tight job market conditions I am not able to find my next contract in bay area, which was my current location when we filed I485 in Aug 2007. So, may be we got to relocate to other state say Texas. So, I was wondering what would be the impact of the move on our pending I485 applications after we change address using AR11 form. Should we avoid such move while I485 is pending?

Hi,
What is the difference between "reject" and "deny" in USCIS terms? Is it that reject is even before the case is processed and when application is returned back immediately and "deny" is later when the case is looked into and then the aplicant is found ineligible for whatever reasons?
If this is indeed the case how much time does one have after getting an RN to submit additional evidence he/she may have missed initially but before the case is processed?
any ideas from the adjucators manual?
