Guys,
I am filing 1-140 and 1-485 together by myself based upn EB-2 ( national interest waiver ) category.
Would any one of you please tell me what I should check Part 2 where it ask " I am applying fr adjustment f permanent status based upon"-- If I choose 2(a), then it ask for copy of approval notice.
Any body has any comments.

My friend and his wife re-entered US on AP a couple of weeks ago....They were paroled into US till Apr 2009. Their APs are valid till Oct 2008. Now his wife needs to go back to her home country immediately for a while (not sure how long due to family emergency).... If she doesn't plan to return before her current AP expires, what are her options to re-enter. My friend is still on H1 status valid till 2010, no H1/H4 visa stamps.....If she intends to stay home longer, can she re-enter US on a H4 visa after getting it stamped...If she plans to return before her current AP expires, say in Sep 2008, is it safe to use AP because she will be out of the country for 5 months if she leaves now and we are not sure if someone can stay out of US for that long and re-enter on AP.....Any suggestions...His PD is April 2004 EB-3 India

Hi,
I got offer for "Manager - Production Support" from my current company where I work as Tech Lead. I know there are issues with job code. I ran this through my attorney and this is her response:
"This would be considered a "material change" in your job for
immigration purposes. You can only make such changes after your green
card application has been pending for 180 days."
Is above correct? Has anybody accepted managerial position while I-485 is pending? Please advice.

Can I file I-485 for self and I-824 (application for changing AOS to CP for approved immigration petition) for dependents, if depedents won't be able to come within a year? If yes, how much time will take to transfer case from AOS to CP?

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

I am from the UK currently on an 18 month J1 visa in the US that expires in a couple of weeks.
I am going back to the UK and will be studying to get a degree and returning to the US for the summer on a temp J1 Visa. My goal is to get the degree and then apply for an H1B Visa to be here for up to 6 years through my employer.
My employer is supportive and would be willing to help sponsor me for a green card application. Can i start that application now and while i am waiting for it to be processed (i understand that it can take many years) still continue on the path of getting my H1 B visa? I would be considered under a employment category 3 as the job that i want is a Camp Director job and needs a bachelors degree.
Any help or advice would be greatly appreciated - i want this more than anything despite the fact that it is going to take years to achieve - i am driven! :)

I joined new job using EAD, didn't invoke AC21, my 140 was approved and I filed 485 in July2007.
There was a RFE for geographical discrepancy explanation and EVL from 140 filed employer or EVL from new employer if changed jobs on 04/29/2009.
(Changed address using AR11 after filing 485)
RFE on 485 on 04/29/2009
LUD on 140 on 05/01/2009
USCIS received EVL from new employer with AC21 - on 05/11/2009
LUD on 485 on 05/13/2009
LUD on 485 on 05/14/2009
Don't know whether they are soft LUD or Hard LUD.
Couple of questions, Is LUD on 140 normal when there is a RFE on 485?
Continuous LUD's on 485 normal?

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. I believe they promise a 15-day (business days, I assume) turnaround on Premium Proc applications. So it could take anywhere between 1 and 15 days, if not longer in certain cases.
Also, why is going to India dependent on receiving on an approval of I-140??
